
The Former Attorney General of the Federation and Minister of Justice, SAN Michael Aondoakaa has analyzed the petition being made by Mr. Peter Obi against the President-elect, Bola Ahmed Tinubu. The Legal Eagle speaking on the petitions stated that there must be a push for the election to be nullified rather than for the votes of the majority winner to be canceled. He alleged that Lawyers often present their cases in court with the perception that the judge should declare them winners because their client scored the lawful votes.
The Senior Advocate argued that things are basically not done like that in the Court. He identified that the petitioner lawyers should rather focus on the procedure that led to the results. He clarified that if the procedure is illegal, the Judges will rule it out as an illegality for everyone and not for one candidate. According to him, the ball is in the court of the lawyers and how they present their cases in the court.
He said, ”This is the time that the Judiciary and everybody involved in the administration should look at some of these issues. In the case of electoral matters, our attitude has been to scrutinize the outcome of the result. This candidate scored this number and the other candidate scored certain number.
And therefore the infraction that occurs is targeted at the result of who has the majority. But the main corruption in an electoral process is the refusal to follow the procedure that leads to the results. And that is what the public is yearning for in this case, nobody will complain about an election if the procedure leading to those results that produce the majority winner is followed.”
